He is also expected to sign a memorandum to repeal the fiduciary rule. The executive order will direct the Treasury Secretary and financial regulators to review and revise rules put into place according to the Dodd-Frank law. In a conversation with the Journal, White House National Economic Council Director Gary Cohn said, "Americans are going to have better choices and Americans are going to have better products because we’re not going to burden the banks with literally hundreds of billions of dollars of regulatory costs every year." Bank stocks are rising on the news. At 6:31 a.m., Bank of America (BAC) was up 1.14%, Goldman Sachs (GS) was up 0.69%, and JPMorgan Chase (JPM) and Wells Fargo (WFC) were both up 0.77%. As head of the National Economic Council, Cohn advises the president on economic matters. He was president of Goldman Sachs and its COO before he was tapped by Trump to lead the federal agency. Goldman was famously one of the banks involved in the subprime mortgage crisis that led to the signing of the Dodd-Frank legislation into law under the Obama administration. (See also: 26 Goldman Sachs Alumni Who Run the World) The Department of Labor's fiduciary rule is scheduled to be implemented starting April 10 and today's memorandum will ask the DOL to repeal it. The regulation, another piece of Obama's legacy Trump would like to get rid of, will force retirement advisors to always act in the best interest of their clients. It is meant to protect retirees' assets and ensure advisors are focused on doing what's best for the client instead of potential kickbacks. (See also: DOL Fiduciary Rule: Everything You Need to Know) Cohn also said the Trump administration is looking to overhaul Fannie Mae and Freddie Mac and replace the current head of the Consumer Financial Protection Bureau, a product of Dodd-Frank. He said, “Personnel is policy,” indicating that the administration will influence the direction of the agency in this way. Today's executive order also paves the way for more orders affecting the Financial Stability Oversight Council, he said. Trump had promised to dismantle Dodd-Frank while he was campaigning last year and recently called it a "disaster." Last year in an interview with Reuters he said, "Dodd-Frank has made it impossible for bankers to function. It makes it very hard for bankers to loan money for people to create jobs, for people with businesses to create jobs. And that has to stop." Earlier this week he signed an executive order to cut small-business regulations. Yesterday House Representatives voted to kill an SEC rule that was created according to a provision in the Dodd-Frank Act. The law in Hong Kong automatically interfaces with the US and EU vis-à-vis exempting the Hong Kong plans from any reporting at all; they only need to report locally which means the whole cost structure is lowest. The noise made by the State Department, that the rest of the world is bad or loving, has no bearing on the technical side of a 402b. If you want to have Americans in a Hong Kong plan with custodian in the USA that is also fine, it is exactly what these agreements are all about. You can work out the benefits for yourself if you want to say, "Don't pay me, pay my retirement plan" then, that slice of your income simply doesn't have tax paid on it for years and years and the compounding effect of that is huge. The Deferred Tax Advantage of RAPS: In our base case, a person making typical deferrals will have a payout at retirement that is approximately 52% larger after taxes than what he or she would have earned with personal after-tax investments. This scenario assumes taxes remain constant with the highest current effective marginal rate and an 8% growth rate. Higher tax rates at the point of deferral increase the advantages of deferred compensation. Conversely, lower taxes decrease the advantages. Note that in an increasing tax rate scenario, results in a deferral advantage of 42%, while a decrease of 5% in the effective tax rate at retirement results in a 62% advantage for deferral. The Regulatory Course Over the last 10 years, governments have introduced a number of new initiatives to clamp down on tax enforcement. The Savings Tax Directive, Article 8 of the Administrative Cooperation and Mutual Assistance Directive of 2011 in the EU, for example, is to be enacted in 2014 and expanded in 2017. The impact of this legislation is to close down traditional offshore financial centers, or so-called "tax havens." In recent years, UK, France, Spain and Portugal have concluded hundreds of Tax Information Exchange Agreements (TIEAs) with traditional offshore financial centers. The UK has been significantly active, introducing information disclosure facilities with Lichtenstein, Switzerland, Channel Islands and Isle of Man. The US has introduced the Foreign Account Tax Compliance Act (FATCA) and the G5 is now preparing similar multilateral information sharing structures. There is no reason to believe that this approach will not become a global phenomenon. In the global FATCA/G5 compliance environment the cost and risk of administrative compliance is both closing existing investment centers and making others prohibitively expensive for banks, brokerages, trust companies, life insurance companies, fiduciaries and their potential clients (e.g. Investment restrictions and constraints on Americans and anyone resident in the UK or US) There are very few foreign financial institutions that know how to traverse this territory for their non-resident clients. Many have in fact left the field or significantly curtailed or fenced their operations within explicit national boundaries. The foregoing analysis has been prepared to share the current landscape of asset protection as well as the current laws. Content: Given the large numbers of actual and aspiring retirees who lack a retirement plan, the term “retirement planning” nearly qualifies as an oxymoron. Experienced planners cite 90% as the portion of people they meet for the first time who have no retirement goals, no less a plan. But why? Frequent reasons for not initiating the planning process include: not taking or making the time; intimidation; discomfort with industry language; lack of financial knowledge; embarrassment, or even a tinge of guilt. Planners universally respond: “Get over it!” With rare exception, people can’t work forever, and must prepare for what may be their longest life segment. Additionally, fiduciary responsibility laws that begin in 2017 put the onus on the planner to act in the client’s best interest, and relieve the client of prior knowledge. Although some retirement specialists might tout themselves with massive assets under management, proven successes, a large client base or similar, some of the essential attributes to seek in a qualified specialist include: • One who speaks and acts with sincerity; who is less driven by formulas and templates, and is more attuned to planning for your unique situation. • An ability to inform from the outset that retirement can be different than anticipated - or what TV commercials portray - and who plans accordingly. • A willingness to ask many questions, even hypothetically, that touch on family situations or similar to gauge probable reactions. • One who probes for all available financial information, even employment histories that might reveal an abandoned or potentially impactful account. More than $1 trillion in 401(k) funds is said to be unaccounted for today. • A regular communicator willing to meet 1:1 at least once a year, if not more, and who is responsive to phone messages and emails. • An integrator of all available assets, including anticipated inheritances, if known. • An ability to account for health and longevity-related issues from the outset, and not as a later add-on, when a situation may have deteriorated. in fact the central bank now my computer kind of exploded so I used to have I came across this a spreadsheet at the bank for international settlements and what I noticed them then it was subsequently verified is how central banks were using derivatives before during and after the crisis but already in two thousand they discussed that central banks use of derivatives really kinds of masks what's happening in the country because it masks what is happening inside of the central bank balance sheet in the CFTC looked at what how the central bank's use derivatives before during and after the crisis which is what I saw on that spreadsheet and what they determined was that and I thought it prior to the crisis it was used a little bit for hedging purposes so let's say that they took a position in a foreign currency and they thought that currency was in trouble okay well maybe they would use a derivative to offset that volatility in that currency not sure why they really had to do it since they can make some money but okay that would make some level of sense however they saw an opportunity and also they needed to take a lot of derivatives off the bank's balance sheet cut me at no value so during the crisis and then afterwards hmm they were using this to enhance returns another words speculates they also notice how synchronized the central bankers were interesting so you can kind of think about it like the central bankers control the bar so we're going to used to maybe have a little sip from the derivative blast every now and again to just kind of stay nice and mellow when the crisis hit and subsequently in there after they're right in there with all of the other players so they weren't from sipping to swigging why not and you can synchronize and plan and should i use the term in you're doing maybe not but if you can if you have the ability to influence the outcome you might get a little full of yourself so I think that nobody should drive drunk. That killer wave is the national debt. Countries, like people, go into debt when they spend more than they have. You and I buy things with the money we earn. Governments buy things with money they get from taxes. When spending outstrips revenue, the government is “in the hole.” Right now, the hole is $17 trillion dollars deep. This is an incomprehensible number. What is a trillion dollars, let alone $17 or 20 trillion? Common analogies like “you’d have to stack $1 bills 67,000 miles high to reach the current debt,” though impressive-sounding, don’t help much, if it all. So, let’s bring the problem down to earth. Right now, most investors believe the United States is a safe bet. They believe, in other words, that they’ll get the money they loan to the US back with interest. But this can’t go on indefinitely. At some point investors are going to say, “you have too much debt; you’re a bad risk. No more money.” What happens then? We don’t have to guess. We can look at Europe, specifically Greece. Investors were happy to loan Greece money until 2010, when it finally dawned on them that Greece couldn’t possibly pay them back. Almost overnight, Greece became a very bad credit risk and the economy went into a death spiral. Businesses failed. Thousands were thrown out of work. The government couldn’t pay its bills. Germany and the other European economies had to step in and bail Greece out. But the Greeks suffered terribly. The same thing happened in Portugal and Spain. Yes, the United States is much, much bigger than Greece and has a much more dynamic economy. That’s true. But the principle doesn’t change. We can borrow more money than Greece, but sooner or later, investors will say “no more.” And if they ever do, our economy will go into the same downward spiral the Greek economy did. Here’s another point. At the time I am giving this course, the interest on our debt is very low, around 2%. But what happens when the interest rate rises from 2% to the much more normal 5% -- as it inevitably will? Where is the U.S. going to get the money to pay the higher interest on its enormous debt? Do we borrow even more? Well, that just gets us deeper in debt. Raise taxes? Well, that cuts economic growth. Then there’s the question of who these investors are who are loaning us all this money. The biggest investor right now is China, not exactly a trusted ally. The more money they loan us, the more influence they have over us.
